Augmented Labs Inc. ("Augmented Labs," "we," "us," or "our") respects your privacy and is committed to handling personal information responsibly. This Policy does not govern Personal Information that Augmented Labs receives from or processes on behalf of a customer in connection with providing Augmented Labs products or services to that customer ("Customer Personal Information"). This Policy also does not govern applicant or employee information where a separate notice or employment-related policy applies.

What Personal Information do we process? The information we process depends on how you interact with Augmented Labs and the Services. The categories are described in Section 1 below.
Do we process sensitive Personal Information? In the ordinary course of the Services covered by this Policy, we do not process sensitive Personal Information through your use of those Services and do not need you to provide it. Please do not send sensitive Personal Information to us unless we specifically request it for a lawful and necessary purpose. Do we receive information from third parties? We may receive Personal Information from public sources, marketing and business partners, social media platforms, service providers, and other lawful sources.
Why do we process Personal Information? We use Personal Information to provide and improve the Services, communicate with you, administer business relationships, conduct marketing, protect our systems, prevent fraud, and comply with legal obligations. We may also process information for other purposes with consent where required.
Do we share Personal Information? We may disclose Personal Information to service providers and other parties in the circumstances described in this Policy. We do not sell Personal Information for monetary consideration.
How do we protect information? We use administrative, technical, and organizational safeguards designed to protect Personal Information. No method of electronic transmission or storage is completely secure, so absolute security cannot be guaranteed.

The Personal Information we collect directly from you depends on your interaction with the Services. Where the GDPR or UK GDPR applies, our legal bases may include consent, performance of a contract or steps taken at your request before entering a contract, compliance with legal obligations, protection of vital interests, and our legitimate interests where those interests are not overridden by your rights and freedoms.
For Personal Information covered by this Policy, Augmented Labs will generally act as a controller where European data-protection law applies because we determine the purposes and means of the processing. This Policy does not apply to Customer Personal Information that we process on behalf of a customer. For that information, the customer generally determines the purposes of processing and Augmented Labs acts in accordance with the applicable customer agreement and instructions.
Where Canadian privacy law applies, we may process Personal Information with your express or implied consent, as appropriate to the sensitivity of the information and the circumstances. You may withdraw consent subject to legal or contractual restrictions and reasonable notice.

Where we use Google Analytics or Google advertising services, Google also makes available tools and settings that may allow you to limit or opt out of certain analytics or advertising uses, including the Google Analytics Opt-out Browser Add-on and Google advertising preference controls.

Augmented Labs and the service providers we use may operate or process information in Canada, the United States, and other countries. Privacy and data-protection laws in those countries may differ from the laws in your jurisdiction. Where required by applicable law, we use contractual, organizational, technical, or other recognized safeguards designed to protect Personal Information transferred across borders.
If European data-protection law applies to a transfer of Personal Information outside Europe, we use an appropriate transfer mechanism where required, such as an adequacy decision, approved standard contractual clauses, or another lawful safeguard designed to provide protections required by applicable European law. Retention periods depend on the nature of the information, the purposes for which it was collected, our business and legal obligations, applicable limitation periods, security considerations, whether an ongoing relationship exists, and any valid deletion request. When Personal Information is no longer required, we will delete or anonymize it where reasonably practicable or, if immediate deletion is not possible because the information remains in backup archives, securely isolate it from further processing until deletion can occur.

We therefore cannot guarantee that unauthorized parties will never defeat security measures or improperly access, acquire, alter, or disclose information. The Services covered by this Policy are directed primarily to businesses and adults. Residents of California and certain other U.S. states may have additional privacy rights under state law, including rights relating to access, correction, deletion, portability, sale or sharing, targeted advertising, and certain profiling or automated decision-making. These rights apply only where the relevant law applies to Augmented Labs and to the particular processing activity. Requests can be submitted as described in Section 12.
If California law applicable to Augmented Labs gives you a right to request information about certain disclosures of Personal Information to third parties for their own direct-marketing purposes, you may submit that request once per calendar year without charge by using the contact method in Section 12. We will respond as required by the law that applies.

We may need to verify your identity before completing a request. Verification may involve asking for information that reasonably matches information we already maintain or contacting you through an email address or other communication method previously associated with you. We will use information provided for verification only for identity, authority, security, fraud-prevention, or request-processing purposes as permitted by law.
Where permitted, you may authorize an agent to submit a request on your behalf. We may require evidence that the agent has authority to act for you and may separately verify your identity or instructions.
We will respond within the period required by applicable law. If we deny or limit a request, we will provide an explanation where required. If applicable law gives you a right to appeal our decision, you may submit the appeal to hello@augmentedlabs.ai. You may also have the right to complain to the privacy commissioner, attorney general, supervisory authority, or other data-protection regulator responsible for your jurisdiction, including the competent authority in the EEA, the UK Information Commissioner's Office, or the Swiss data-protection authority where applicable.
